Britney Spears will have her babies on board!

The pop star has finally gotten her way after rumors circulated that she threatened to cancel her upcoming tour if she was not allowed to bring her sons.

“Both Sean Preston and Jayden James will, in fact, be joining Britney throughout the duration of her tour,” her official website states.

Spears was planning to cancel her upcoming Circus tour if her ex-husband Kevin Federline’s lawyers continued to block an agreement that would allow her to take her sons on the road.

For weeks, Spears, Federline and Spears’ father Jamie had been privately planning to let the two boys travel with Spears on the tour. According to TMZ.com, the pop star would have homes in three places — New Jersey, New Orleans and Los Angeles — so that the children could stay nearby while Spears commuted back and forth from regional concert venues.

Additionally, the agreement allowed Kevin to receive at least $4,000 each week that Spears is on tour and that he would receive his own home in each of the three predetermined cities as well, reported TMZ Monday.

Because the agreement was made without Federline’s lawyers, they objected to the plan, TMZ reported, but now it seems the family has worked out an arrangement.

“Britney is so excited to kick off her tour,” says a posting on Spears’ official site. “She has been enjoying every moment of rehearsals and is looking forward to performing in front of a live audience again.”

The Circus tour — her first arena tour in five years — kicks off on March 3 in New Orleans. It runs until June.

Britney Spears will not have to undergo questioning in a Florida civil case filed by her former manager at least until summer.

Clay Townsend, an attorney who represents Johnny Wright, said the pop singer won’t have to be deposed until August, following a closed hearing Monday. Townsend argued that Spears appears competent based on interviews and appearances.

A court commissioner blocked efforts last year to depose Spears in the case, which was filed in Orlando, Fla.

Townsend claims she is the only person who can answer questions about specific periods of her music career. Attorneys for Spears’ father, who has control over the singer’s personal and financial affairs, declined comment.

Ashton Kutcher is standing up for Michael Phelps after photos surfaced of the Olympian smoking marijuana.

“God forbid he hit a bong,” Kutcher Twittered about the incident on Monday. “Go ask your 20-year-old kid what they did last weekend.

“I’m not saying it was a smart move. But he doesn’t need to be publicly outed for it,” Kutcher went on.

The photo wound up in a British tabloid Sunday. Kutcher said, “Whoever put the pic out is an a**!”

Of Phelps - who was arrested for DUI in 2004 - Kutcher wrote: “He’s a good kid.”

While Kutcher said he hasn’t smoked pot “in quite some time … I’m not immune to a lapse in good judgment from time to time.”

On Sunday, Phelps released a statement, apologizing for his “regrettable” behavior. The photo was taken during a November house party while Phelps was visiting the University of South Carolina.

“I’m 23 years old and despite the successes I’ve had in the pool, I acted in a youthful and inappropriate way, not in a manner people have come to expect from me,” he said. “For this, I am sorry. I promise my fans and the public it will not happen again.”

It remains to be seen whether the scandal will cost Phelps his slew of lucrative endorsement deals.

Luxury Swiss watchmaker Omega called Phelps’ actions a private matter and a “non-issue,” while Speedo said Phelps still remains a “valued member of the Speedo team.”

This is one birthday Justin Timberlake won’t soon forget.

Jessica Biel, 26, threw her singer beau a Super Bowl-themed surprise birthday party in the Hollywood Roosevelt Hotel’s ultra-exclusive penthouse on Sunday afternoon, PEOPLE has learned.

“Justin was totally blown away when he walked in. He had no idea,” says a source.

On hand were close to 100 friends and family of the couple, including both of their parents, Biel’s brothers, Timberlake’s cousins and his best friend Trace Ayala, who joined the happy pair to toast Timberlake turning 28.

The penthouse was transformed with flat-screen televisions brought in especially for the festivities, and the party feasted on gourmet buffalo wings, pizza, mini sliders and red velvet cupcakes.

Biel planned the party down to every last detail, and visited the hotel to make sure everything would be just perfect, says the source.

And she was the perfect hostess. Wearing a little black cotton dress and flats, Biel worked the room while taking breaks to sit with Timberlake.

“They held hands and relaxed,” says a guest. “They seemed very happy together.”

Lindsay Lohan’s frame isn’t the only thing that’s fading — it seems her star status is too.

The 22-year-old caused chaos while departing on a Delta Flight from Tampa, Fla. on Saturday morning when the airline was unable to provide her with a first-class seat on the already overbooked flight. According to an insider, passengers laughed as the starlet acted incredibly entitled (and embarrassed), stomped around and warned a friend traveling with her: “you’d better come and visit me back there in case I die.”

But fortunately for Linds, she didn’t have to suffer the life-threatening ill of business or economy class as she was eventually moved into first following her entertaining tantrum. Phew. However it seems as though the Mean Girls starlet is being plagued by even more problems in her personal life.

On Friday night, Lohan accompanied Samantha Ronson to ESPN The Magazine’s NEXT Pre-Super Bowl bash and the two apparently had yet another tiff. Pop Tarts has been told that an angry-looking Lindsay hung out near Sam’s D.J. booth chain-smoking until the early hours while shooting her dirty looks. According to our insider, Lohan continued to grab Ronson’s blackberry obsessively and check her messages before an inevitable feud broke out. The two later headed to the ladies’ to “sort it out” and came out smiling.

“They’re always breaking up,” a source close to the couple told Tarts. “Samantha won’t let Lindsay go, she doesn’t have a career without her.”

And while the party peeps all enjoyed shots of Patron, the “reformed” rehabber made a public display of only drinking Red Bull, although word has it that a secret stash of liquor was later found underneath Lilo’s table … Is our girl going through a relapse?
