SOME divas cling to their high-maintenance ways even at moments of historic national import. Mariah Carey, who performed at the Neighborhood Ball for President and Michelle Obama, was “furious” when she found out where she’d be seated for the inauguration. A spy said, “Mariah was in the VIP area, where every celebrity, like Jon Bon Jovi, Mary J. Blige, Alicia Keys and Bruce Springsteen, was seated. But somehow she thought she’d be up with the Obama family. When she realized she wasn’t, she bailed.” Meanwhile, Carey ex Sean Combs is said to be upset that he wasn’t invited to perform at official events and disappointed that Jay-Z had a bigger presence. A rep for Carey declined to comment. Combs’ rep said, “It was one of the greatest moments of his life. Sean was invited to the inauguration and was seated third row, with Jay-Z, at the ceremony.”

TRUDIE Styler drew a stellar crowd at the Sundance Film Festival to the dinner celebrating her documentary “Crude” (as in oil) thrown by Self magazine editrix Lucy Danziger. Such guests as Sting, Pierce Brosnan, Kevin Bacon, Tessa Benson and Emma Roberts were surprised by “Access Hollywood” host Billy Bush, who tried to crash the bash but was escorted across the street by his pal, NBC Entertainment chief Ben Silverman. Sting stayed close to the deejay booth and danced until the wee hours.

Hayden Panettiere’s father pled no contest to misdemeanor battery, TMZ.com reported Thursday.

Alan faced a judge in a Beverly Hills courtroom on Tuesday. He was arrested in August on a charge of felony domestic violence for allegedly hitting wife Lesley in the cheek, leaving a visible bruise. They were spotted arguing at a Hollywood charity benefit earlier in the night.

Police were summoned to their West Hollywood home at 3:15 a.m. after the incident.

Alan received 24 months probation, $400 in fines and must attend a year of domestic violence counseling, according to TMZ.

A protective order against him also remains in place.

Both Alan and Lesley have been downplaying the arrest.

“It was all a big misunderstanding,” Alan recently told Extra.

Although a police report claims Alan struck Lesley three times, the couple insist “nothing actually happened.

“[We] love each other very much and want everyone to know that the matter was completely blown out of proportion,” they told Extra.

Extra reported that Hayden found out about her dad’s arrest when he called her from jail.

Panettiere’s rep had no response to news of her father’s plea.

Kelly Rutherford and her estranged husband Daniel Giersch took the stand Thursday afternoon in their increasingly heated custody case. A judge at the California Superior Court in Santa Monica ordered them to testify so that he could decide whether Rutherford, 40, can take their son Hermes, 2, to NYC — where she shoots Gossip Girl — through March 2009.

“I’m okay. It’s a lot to do. I’m optimistic,” Rutherford said after the hearing adjourned for the day. “The show has been really great and supportive — and family and friends here. It’s helped a lot.”

Although she refused to address allegations brought up by Giersch, she does say she wants to be fair to both parties and even mentioned gradually offering Giersch overnight visitation rights in court.

“I want what’s best for Daniel and what’s best for the family ultimately,” she said.

The hearing will continue Friday morning. After lawyers finish cross-examining Rutherford and once closing arguments are given, Judge Michael Levanas said he will rule on the matter.

“The parties are in a difficult situation,” Levanas said in court. “Certain things are certain. They both have a good relationship with their son.” He went on to say that both Rutherford and Giersch were good parents.

Giersch wanted the judge to prohibit Rutherford — who’s four months pregnant with their daughter — from taking the boy, claiming that she has anger issues. He has alleged that she once threw a laptop at him and “tried to hit him with an open fist.” (Her rep denies those claims. Rutherford has also alleged that she had to call the police on Giersch because he frightened her.)

During Thursday’s hearing, Rutherford was asked if partial custody would be a strain on the actress.

“I think being away from my son would be the most stressful,” she said. “It is very rare that I have spent an entire day away from him.”

In a declaration filed with the court on Wednesday, Giersch attacked Rutherford’s ability to care for their son. He claimed she doesn’t properly change Hermes’ diapers and has been preventing Giersch from seeing his son “presumably to punish me.” He also said he was against her signing a recent contract with Gossip Girl.

“She signed her current contract for her show without my consent, and in fact with my expressed disapproval,” he wrote.

During the hearing, Rutherford mentioned that she would leave Gossip Girl if necessary.

“If i’m being asked to choose that over my son, I’d choose my son,” she said.

His declaration also revealed that Rutherford has been offered a role in a new CW revival of Melrose Place.

“[Rutherford] told me before we separated that she had been offered a part on that show, which will be filming in Los Angeles, and she would be able to change shows, and continue to work for the same employer but in Los Angeles,” he wrote.

In court Thursday, Rutherford’s lawyer, Lance Spiegel, asked Giersch if he thought the idea of Rutherford flying back and forth from L.A. to New York would be a strain on her pregnancy, Giersch replied, “I think it will reduce the stress.”

Giersch, who says he spends 95 percent of his time with Hermes, described in detail how he took care of his son while living in a hotel and complained of the “flying in, flying out” lifestyle.

Outside the courtroom, Rutherford (dressed in a black sweater and black pants), said “the love of my child and the child that’s on the way” is what’s getting her through the ordeal.

“I’m trying to just think about my kids and the future,” she said. “I am thankful to have a job in this environment and be a mother at 40.”

Rutherford, who drove herself to court, thanked the crowd of reporters for their support.

On Friday’s Tyra Banks Show, Andy Dick — who currently stars on VH1’s Sober House with Dr. Drew — opens up about his battle with alcoholism and his bisexuality.

The 43-year old Dick — who has been charged a number of times with DUI and drug possession (in 2008, he was busted for marijuana possession) — said living under Dr. Drew’s roof (his 10th rehab program) is challenging due to the “no sex” rule.

“He’s got the animal caged,” Dick says of Dr. Drew. “I’m under his care officially, and he’s like, ‘Look, folks … he ain’t gonna attack.’”

He says his substance abuse problems are over.

“I know that I’m ready to turn a corner with my alcoholism because I’m willing to talk about it,” says Dick, who has to wear an alcohol monitoring bracelet for a year. “Believe it or not, my last bout with alcohol was beer.”

Dick also revealed that he is “tri-sexual.”

“I’ll try anything,” he told Banks. “I really have tried everything, except nothing with animals. There’s only room for one animal - that would be me.”

Dick — who said he is equally attracted to both men and women — said he is “not accepted” as bisexual in either the gay or straight community.

“I say, ‘I’m bi, my love knows no gender,’ and the straight community says, ‘Oh right, that’s just a cover-up - you’re gay!’” Dick said.

“And the gay community says, ‘Yeah right, that’s just a cover-up - you’re gay,’” he went on. “They both want to push me gay.”

Dick said he has “been monogamous” with mostly women his whole life.

“I’ve never been monogamous with a man,” he said. “When I’m with men, usually I’m out of my mind drinking. Dr. Drew says ‘using,’ but then it sounds like I’m a heroin addict.”

With news that Dakota Fanning will meet with New Moon director Chris Weitz next week to formally discuss her being offered the role of vampire Jane in the Twilight sequel, it’s time for us to help Weitz find his Alec, Jane’s bloodsucker brother. According to the books, Alec is a pale boy (surprise) who could be Jane’s twin. “His hair was darker, and his lips were not as full, but he was just as lovely,” Stephenie Meyer writes in New Moon. Elijah Wood is a popular suggestion, since Jane and Alec are small in stature, but I doubt that the man who starred in the Lord of the Rings trilogy would want to be backburner in a Twilight sequel. Then again, if Weitz (or the director of any future Twilight sequels) wanted to go off-book and flesh out the fascinating Volturi and their guard with Meyer’s approval, I don’t think anyone would mind. (Right?) Also, what is Elijah Wood doing these days?

Assuming Wood is out, I submit High School Musical’s Lucas Grabeel (pictured) for consideration. He might be a bit too tall to pair with Fanning, but they could always have him stand/walk in a shallow hole/trench. (Really, he’s not going to be onscreen that long for it to become a huge inconvenience.) To me, Grabeel’s face is angelic, but also blank — perfect for a character who is able to cut off all your senses and make you feel absolutely nothing. Together, he and Fanning (character gift: to bring the pain) would be appropriately off-putting. Plus, they’d look so cute together.

In a tearful conversation, Sharon Osbourne confirmed that daughter Kelly, 23, was back in rehab.
“Yeah, Kelly’s in rehab,” the matriarch of the Osbourne clan confirmed to RadarOnline.com.

“What else can we say? She knew that it was the right thing to do at this point and we’re proud that she did it. The family is all standing behind her. Kelly knew that she needed help and she’s getting it.”

Sharon didn’t want to reveal the location of the rehab facility where Kelly will be for at at least the next 30 days, except to say that it was outside the L.A. area.

Nor did she want to discuss what she’s getting help for.

“Kelly will tell you herself when she gets out,” Sharon promised.

“We just pray that everything’s going to be okay.”

Sharon said that Kelly had been working steadily with her, dad Ozzy Osbourne and brother Jack on Fox TV’s new Osbournes Relodaded variety show prior to her entering rehab.

“She been working right up until she went in.”

Her voice choking with emotion, Sharon ended by saying, “This is one of the absolute worst things that a parent can face, for their child to go through rehab. And not once, but twice.

“However, we are all very glad Kelly’s doing it.”

Poor Brad Pitt is so busy jet setting the world promoting The Curious Care of Benjamin Button, going to Awards shows in The States and filming Inglourious Basterds in Berlin plus he is the father of 6 kids under 7 and doing Angelina Joile, that he forgot to zip up his jeans. Which is bad for him, but is great for us! And it could have been even better had his little Basterd come out to play!!! To be honest I am surprised he even has the energy to get dressed!
